Preamble: General Framework of the Rental Agreement

These rental terms and conditions define the framework under which HOLLAND BIKES VELOMOTION provides short-term bicycle rental services.

HOLLAND BIKES VELOMOTION is a simplified joint-stock company registered with the Paris Trade and Companies Register under number 442 110 789, with its registered office at 79 ter boulevard Lefebvre, 75015 Paris, France, and EU VAT number 66 442 110 789.

Article 1: Ownership and Responsibility for the Equipment

The bicycles and accessories remain at all times the exclusive property of Holland Bikes. You accept full responsibility for the maintenance of the equipment and are liable for any damage or loss. You have 30 minutes from the start of use to report any malfunction. After this period, any repair resulting from use of the equipment will be charged to you and may incur additional costs. Holland Bikes will invoice you according to the Replacement & Repair Cost List.

Article 2: User Liability

The equipment is used entirely at your own risk. You release Holland Bikes from any liability in the event of injury or damage caused to the user(s) of the equipment, to any third party, or to property. You agree not to make any claim against Holland Bikes for injuries or damages arising from cycling or the use of the equipment. (Articles 1383 and 1384 of the French Civil Code).

Article 3: Theft Protection and Coverage

You have the option to purchase theft protection. This coverage applies only in the event of theft and only upon presentation of an official police report as described below. A deductible may apply depending on the level of coverage selected.

The theft protection does not cover damage or theft of accessories, displays, chargers, or batteries of an e-bike. The complete list of damages and corresponding repair costs is available via the link below: Replacement & Repair Cost List.

Article 4: Conditions of Use

It is strictly forbidden to modify or carry out major repairs on the bicycles, to sublet or lend them, to remove the orange triangle, or to carry a passenger on the rear rack other than a child in an approved child seat.

Regarding the rental of a phone holder, Holland Bikes is not responsible for any damage to your phone resulting from its use.

Article 5: Safety Measures and Parking Requirements

Our bicycles are equipped with a chain lock that must be used at all times when parking the bike. The bicycle frame must be locked to a fixed object that cannot be moved or removed. Please do not attach bicycles to monuments. Overnight, bicycles must be parked indoors and locked. If you have rented an e-bike or e-cargo bike, please remove the battery and the detachable display overnight.

If the bicycle has not been locked in accordance with these conditions, theft protection — even if purchased — will not apply.

Article 6: Return of the Bicycle

Bikes rented and collected from our shop at Domaine des Ormes must be returned to the same rental shop.

Article 7: Assistance and Breakdown Service

In the event of a breakdown and the impossibility of returning the bike to the rental point, you must lock the bike by the frame to a sturdy object that cannot be moved or dismantled. You agree to photograph the exact location and send all information needed for retrieval to our team by email or phone. A replacement bike will then be offered. Please note that we operate only within Domaine des Ormes. For assistance outside the holiday village, bike repatriation will be charged €100.

Article 8: Payment and Credit Card Authorization

You authorize Holland Bikes to use your credit card information to pay for the rental and to cover any potential damage and/or loss of the bicycle(s).

Article 9: End of the Rental Agreement

The rental contract ends once the bicycles have been returned and inspected by a Holland Bikes staff member.

Article 10: Security Deposit

Your credit card will serve as a deposit; no charge or pre-authorization will be made unless necessary.

Article 11: Late or Unnotified Returns

If you return your bicycle late (after the contractual rental period) without notifying our customer service, Holland Bikes reserves the right to charge an administrative fee of €50 per bicycle, in addition to any extra rental charges.

Article 12: Booking Commitment and Modifications

You have up to 24 hours before the start of the rental period to inform Holland Bikes of any changes to your booking. In the event of cancellation less than 24 hours before the start, no refund will be issued. Once the rental contract is concluded, you cannot shorten the rental duration. Holland Bikes does not issue refunds for early returns. If you return the bicycles before the end of your booking period, you will lose any special offers that no longer apply.

If you wish to extend your rental contract, please contact your Holland Bikes store to check the availability of the bicycles. To obtain a refund, you must cancel your booking at least 48 hours before the rental start date.

Different cancellation terms apply to corporate and student groups.

Article 13: No Right of Withdrawal

Pursuant to Article L. 221-28, 12° of the French Consumer Code, the right of withdrawal does not apply to contracts for “accommodation services (other than residential accommodation), transport of goods, car rental, catering, or leisure activities provided on a specific date or within a specific period.”

Given the nature of the services provided by Holland Bikes, you therefore have no right of withdrawal for short-term bicycle rentals.

Article 14: Disputes and Mediation

All disputes relating to the rental contract shall be governed by French law and subject to the jurisdiction of the courts of Paris, France.

In the event of a dispute, Holland Bikes undertakes to seek an amicable resolution.
